1. Purpose
This policy is established to ensure that the listing activities of individual sellers on OhZui comply with the laws of Japan, including but not limited to the Antique Dealings Act and other relevant regulations.
Individual sellers (hereinafter referred to as “Sellers”) must comply with all provisions set forth herein when using OhZui’s services.
2. Conditions for Individual Listings
Sellers may only list products that they legally own and that do not infringe upon any third-party rights.
Sellers represent and warrant that:
- The listed items are their personal belongings and have been used or possessed legitimately;
- The items are not procured for the purpose of resale or commercial profit;
- The items do not fall under prohibited categories under Japanese law or OhZui’s internal policies.
All product photos must be actual images of the item being sold.
The use of illustrative images, stock photos, or images taken from other sources is strictly prohibited.
If OhZui discovers that the listed image does not match the actual item sent to the buyer, the seller’s account will be immediately suspended and permanently prohibited from selling on OhZui.
If a Seller engages in activities that constitute regular purchase-and-resale, commercial trading, or behavior deemed equivalent to business operations, the Seller is responsible for obtaining an appropriate dealer license (Kobutsusho License) as required under Japanese law.
3. Obligation to Verify Authenticity and Item Origin
Sellers must ensure the lawful origin of all listed items.
When necessary, OhZui may request Sellers to provide:
- Receipts or proof of purchase
- Documents verifying ownership
- Detailed information regarding the origin of the item
If an item is suspected of being stolen, counterfeit, or illegally obtained, OhZui may:
- Temporarily suspend or delete the listing
- Provide relevant information to Japanese law enforcement authorities
- Suspend or terminate the Seller’s account
4. Account Verification (KYC Requirement)
To prevent fraud and ensure compliance with legal obligations, Sellers must complete identity verification (KYC) when requested.
Required information may include:
- Full name
- Residential address
- Contact information
- Valid identification documents (My Number card, Residence Card, Passport, Driver’s License, etc.)
5. Prohibited Activities
The following activities are strictly prohibited:
- Listing items not owned by the Seller, or items owned by third parties without proper authorization
- Regular purchasing and reselling of goods for commercial purposes without possessing a Kobutsusho License
- Fraud, product switching, selling counterfeit or imitation goods, or items infringing intellectual property rights
- Selling prohibited items under Japanese law or OhZui’s policies
6. Legal Responsibility
Sellers bear full legal responsibility under Japanese law for:
- The legality of their listed products
- All actions related to selling and transactions
- Obtaining required business licenses if their activities constitute commercial operations
OhZui acts solely as an online platform and is not a party to transactions between Sellers and Buyers.
If required by law enforcement, OhZui will cooperate by providing information in accordance with legal procedures, and all resulting liabilities shall be borne by the Seller.
7. OhZui’s Rights and Enforcement Measures
OhZui reserves the right to:
- Temporarily suspend or remove listings that violate this policy
- Suspend Seller accounts in cases of repeated violations or suspected fraudulent activity
- Reject or restrict listing privileges if the Seller fails to meet legal requirements or KYC obligations
- Withhold or block suspicious transactions, and notify relevant authorities when necessary
8. Acceptance and Consent
By using OhZui’s listing services, the Seller acknowledges and agrees that:
- They have read, understood, and accepted the entirety of this policy
- They assume full responsibility for all listed products and related actions
- They will comply with Japanese law and all OhZui rules and regulations
