1. Purpose
This Policy aims to ensure that the listing and sales activities of corporate sellers (“Business Sellers”) on the OhZui platform comply with Japanese laws, protect buyers’ rights, and maintain a safe and trustworthy marketplace environment.
2. Eligibility and Requirements for Business Sellers
Business Sellers must be legally registered entities in Japan or internationally, and must possess:
- A valid business license;
- A legally authorized representative;
- Registered business information (including the Tōkibotōhon for Japanese corporations).
Depending on the category of goods, additional industry-specific permits may be required under Japanese law (e.g., Kobutsusho Kyoka for second-hand goods, permits for food, cosmetics, electrical appliances, alcohol, etc.).
Business Sellers must provide the following information to OhZui:
- Legal entity name;
- Office or registered address;
- Tax ID / business registration number;
- Representative’s name and contact information;
- Business website (if applicable).
3. Obligations for Listed Products
All listed products must comply with:
- Japanese Commercial Law;
- Anti-Counterfeiting laws;
- Consumer Protection laws;
- JAS, food, cosmetic, and category-specific regulations;
- Import requirements for foreign goods (if applicable).
Products must be genuine, authentic, and have clear proof of origin. Items that infringe copyrights, trademarks, or any third-party intellectual property rights are strictly prohibited.
Product images must be actual, real photos of the items being sold.
The use of stock images, illustrations, or photos taken from external sources is strictly prohibited.
If a discrepancy is found between the listed image and the actual product shipped to the buyer, the seller’s account will be immediately suspended and permanently banned from selling on OhZui.
Product listings must include complete and accurate information, such as:
- Product condition (new/used);
- Specifications;
- Warranty conditions;
- Expiration date (for food, cosmetics, etc.);
- Transparent pricing.
4. Mandatory Information Required Under Japanese Law
Business Sellers must display all information required under the Act on Specified Commercial Transactions (特定商取引法 – Tokutei Shōtorihiki-hō), including:
- Company name;
- Company address;
- Representative’s name;
- Phone number;
- Email address;
- Shipping fees and other related charges;
- Return / refund conditions;
- Estimated delivery time;
- After-sales service policies.
OhZui reserves the right to request additional information if the provided details are incomplete.
5. Obligations When Selling Second-Hand Goods (If Applicable)
If the Business Seller deals in second-hand goods, the seller must:
- Possess a valid Secondhand Dealer License (Kobutsusho Kyoka);
- Maintain transaction records as required by law (seller’s name, transaction date, item description, price, etc.);
- Verify and confirm the lawful origin of all goods.
OhZui may request a copy of the license for verification when necessary.
6. Customer Service Responsibilities
Business Sellers are responsible for:
- Responding to inquiries and complaints within a reasonable time;
- Handling delivery issues, cancellations, returns, and refunds in accordance with Japanese law and OhZui policies;
- Providing invoices or transaction documents upon the buyer’s request.
7. Prohibited Activities
The following actions are strictly prohibited:
- Selling counterfeit or imitation goods;
- Selling items that do not meet legal safety standards (electrical, medical, cosmetic, food, etc.);
- Selling smuggled products, tax-evaded goods, or items without proper documentation;
- Misusing customer data for purposes unrelated to the transaction;
- Using the platform as a channel for illegal or fraudulent activities.
8. Legal Responsibility
Business Sellers bear full responsibility for their products, licenses, business operations, and all legal consequences arising from their listings.
OhZui acts solely as an intermediary platform and is not the seller of any product. OhZui is not liable for disputes related to product quality or origin unless otherwise required by law.
If a Business Seller causes loss or damage to buyers or OhZui, the seller shall be solely responsible for compensation.
9. OhZui’s Rights and Enforcement Actions
OhZui reserves the right to:
- Request proof of licenses or related legal documentation;
- Temporarily remove or suspend listings that violate regulations;
- Temporarily suspend or permanently terminate seller accounts found to be in violation of laws or OhZui policies;
- Report suspected serious violations to relevant authorities.
10. Acceptance and Agreement
By listing products on OhZui, the Business Seller confirms that they:
- Have read, understood, and agreed to this Policy;
- Assume full responsibility for all products and transactions they list;
- Commit to complying with Japanese laws and all OhZui regulations.
